ELECTRIC VEHICLE CHARGING STATIONS

DEFINITIONS

Stop And Go: Stop And Go (including its officers and employees) and, where the context requires, includes any lawfully appointed agent or successor (including any of its officers and employees).

EV: is a registered electrical vehicle for use on roads whose one of / main energy source is electricity, and where the context requires, includes any passenger.

Charging Station: is an EV charging unit that Stop And Go owns or manage and that is suitable for charging an EV, and includes equipment associated with the charging unit.

Limited Terms & Conditions: are the terms and conditions stated in this document, as may be updated from time to time.

We: means the entity that is the owner or manager of a Charging Station (including its officers and employees) that is identified on the Charging Station and, where the context requires, includes any lawfully appointed agent or successor of the owner (including any of its officers and employees), and "our" takes an appropriate meaning.

You: is the person wishing to connect an EV to a Charging Station, and your takes an appropriate meaning.

Stop And Go TERMS & CONDITIONS

By using one of our Charging Stations to which these Terms and Conditions apply, you acknowledge that you have read and understood these Terms and Conditions, and that you agree to be bound by them. If you do not agree, you must not use the Charging Station and you must not actively or passively prevent or obstruct any other person or vehicle from having access to the Charging Station.

WHAT YOU NEED TO DO

You must take all reasonable efforts to make sure that you follow the instructions that are displayed on or near the Charging Station or through the mobile application or any other similar means. These instructions may change at any time and it is your responsibility to make sure that you follow the instructions that are displayed at the time you use the Charging Station.

Your EV handbook shall describe how to recharge your EV safely and efficiently, and you must take all reasonable efforts to recharge your EV in accordance with the guideline.

You must only use, or attempt to use, our Charging Station for recharging an EV if your EV is compatible with that Charging Station.

Your use of one of our Charging Stations must be fair and reasonable and must not be excessive. If, in our or Stop And Go's discretion, we consider that your usage is unfair, unreasonable or excessive, either we or Stop And Go may immediately suspend, modify or restrict your access to any or all Charging Stations to which these Terms and Conditions apply.

You must not use one of our Charging Stations in a way that will put the Charging Station, you, any other person, your EV or any other person's EV at unnecessary risk.

If you are not the owner of the EV you wish to recharge at one of our Charging Stations, you warrant that the owner has authorized you to use one of our Charging Stations and, by connecting the EV to the Charging Station, you have authority to bind the owner to these Terms and Conditions.

You acknowledge that our Charging Stations will not be supervised and that you will use them at your own risk.

When you are using one of our Charging Stations you agree to keep the area around the Charging Station clean and tidy, and to comply with any reasonable request the property owner makes when you are using that Charging Station including any request to immediately suspend, modify or restrict your access to the Charging Station.

You must comply with any reasonable request we make of you when you are using one of our Charging Stations.

You must comply with your duties under the health and safety environment, including but not limited to taking reasonable care of your health and safety; taking reasonable care that your acts do not adversely affect the health and safety of any other person; and complying as far as you are reasonably able, with any reasonable instruction that is given to you by us.

LIABILITIES

You are liable and responsible for compensating all affected parties in the case of direct or indirect loss or damages caused by your use of one of our Charging Stations.

By using one of our Charging Stations, you are confirming and warranting to us that your EV battery has a healthy status (as appropriate) and does not harm or danger environment or detachable devices.

We will make every effort to ensure that a Charging Station is fit for the purpose of charging an EV that is to be used on roads, but we cannot and will not guarantee that connecting your EV to one of our Charging Stations will result in a successful and timely recharge of your EV's battery or batteries.

We are not liable to you, and will not indemnify you, as a result of any direct or indirect loss or damage that you or your EV may suffer as a result of you using or having used one of our Charging Stations, including any direct or indirect loss or damage arising from an unforeseen event, or caused by something beyond our control (including, for the avoidance of doubt, any act or omission of any third party, any force majeure event or any breach by you of these Terms and Conditions).

To the maximum extent permitted by law, we will not be liable to you for any other loss or damage arising (whether direct or indirect, special or consequential, pecuniary or non-pecuniary, and whether arising in tort (including negligence) or contract or otherwise) as a result of, or in connection with, your use of one of our Charging Stations.

WHAT WE NEED TO DO

We will provide Charging Stations as we see fit to enable you to recharge your EV. In doing so, we may suspend or refuse your access to a Charging Station at any time, including but not limited to suspend cost / cost-free charging.

We will endeavor to keep our Charging Stations free from any faults, errors or defects but we do not guarantee, and are under no obligation to ensure the availability, compatibility with your EV, or performance of any of our Charging Stations, nor are we able to guarantee an uninterrupted supply of electricity to our Charging Stations.

We will make sure that, at all times when they are available for use, our Charging Stations comply with all relevant statutory requirements and appropriate industry standards.

We must take reasonably practicable steps to ensure that the health and safety risks arising from the use of one of our Charging Stations is (if possible) eliminated or (if this is not possible) minimized; your health and safety, and that of any other person, is not put at risk from work that we carry out as part of the operation of the Charging Station; the instructions about how to use the Charging Station are as clear as we can practicably make them; and you know how to contact us if you need to.

FURTHER TERMS

All personal information that we may collect and/or hold about you in connection with your use of a Charging Station is protected.

As a user of one of our Charging Stations, we may ask you to provide certain personal information to us. You agree that we may collect any such information so that we, one of our related entities or Stop And Go may use it in the course of our or Stop And Go's business, including direct marketing activities.

We may amend these Terms and Conditions at any time and for any reason. Each time you use one of our Charging Stations you agree to be bound by the current terms and conditions.

These Terms and Conditions are binding on, and enforceable by, either of us as if they were a contract between us.

These Terms and Conditions are subject to Palestine laws in Ramallah court. Any legal proceedings arising out of these Terms and Conditions will agreed in mutual writing.

Fees

You agree to pay the amount of our Charging Stations use as stated in the payment channels, mobile application and where else apply.

New users of our Charging Stations are subject to pay registration fees for one time only; and will be deducted the first refill balance transaction as will be stated in our payment channels, mobile application and where else apply.

Other fees are affected on yearly basis; this ultimate shall be automatically renewed and will be deducted at the beginning of each year. In case users have no credit, then the subscription will be respectively suspended till a transaction is made to top up your balance. Amount fees will be stated in the payment channels, mobile application and where else apply.

Charging Session Refund Policy

User Registration

To use our services, you must be a registered user. To register, download the Stop and Go App from the respective app stores and provide your personal information, such as phone number, email, and name. You can register using your phone number, email, or Facebook account. Additional personal information may be required after registration, depending on the services you request.

Connection to the Service

You can access the charging points using the Stop and Go App.

Charging Session

A charging session begins when you connect to the charging point through the app and ends when the timer for the session runs out or when you manually terminate the session from the app. It is your responsibility to ensure that the charging session starts and completes correctly. You can refer to the LED status of the charger to verify the charging status.

Procedure for Requesting Refund

If you need a refund you can contact the Stop and Go team by sending an email to support@stopandgo.services with the reason for the refund request. Refunds will only be processed for requests submitted within 72 hours of the booking. Refund requests made after 72 hours of the booking date will not be eligible for refunds. The approval and settlement of refund requests may take up to 3 to 5 business days.

Eligibility Criteria for Refunds

Refunds may be considered under the following circumstances:

In cases where there are energy consumption values, a partial refund can be done based on the usage.

In cases where the payment was successful, and the user was unable to go to the booking page, the transaction ID shall be collected from the user and cross-verified with the concerned team internally. If found eligible, a refund shall be processed for the user.

Refunds shall not be considered for any other cases. Refunds will not be considered in cases where the payment has failed, as the user will be refunded automatically within 7 business days by the payment gateway itself.

Disclaimer

The refund process may take an unexpected amount of time due to technical issues from banking partners. Stop and Go will not take liability in such cases.
